II. PROCESSING OF PERSONAL DATA WHEN ACCESSING OUR WEBSITES

When you use WECUBEX websites, applications or online tools (each a “WECUBEX Online Service”), WECUBEX processes the following personal data:

• Personal data that you voluntarily enter as part of a WECUBEX Online Service (such as when registering, making contact enquiries or participating in surveys, etc.), such as your first and last name, email address, telephone number, or information provided, for example, as part of a support request.
• Information that is automatically sent to us by your web browser or device, such as your IP address, device type, browser type, previously visited website, pages visited or the date and time of the respective visitor request.

We process your personal data for the following purposes in order to enable you to make use of the services and functions of the WECUBEX Online Services,

• to establish your identity and enable user authentication,

• to contact our visitors and users with general or personalised service-related information and advertising messages,
• to create aggregated statistical data and other aggregated and/or derived non-personal information that we can use to provide and improve our services,
• to enforce our terms of use, assert or defend legal claims, and prevent and stop fraudulent and similar activities, including attacks on our IT infrastructure.

The processing of personal data is necessary to achieve the purposes stated above. Unless expressly stated otherwise when the personal data is collected, the legal basis for processing the data is:

• the performance and fulfilment of a contract with you (Article 6 (1) (b) of the General Data Protection Regulation),
• compliance with legal obligations to which WECUBEX is subject (Article 6 (1) (c) of the General Data Protection Regulation), or
• the protection of WECUBEX’s legitimate interests (Article 6 (1) (f) of the General Data Protection Regulation). WECUBEX’s legitimate interest lies in processing your personal data for the purpose of providing and operating the WECUBEX Online Services.

In some cases, we will expressly ask you to consent to the processing of your personal data. In this case, the legal basis for processing your personal data is the consent you have given (Article 6 (1) (a) of the General Data Protection Regulation).

III. PROCESSING OF PERSONAL DATA OF BUSINESS PARTNERS

Data Categories, Purpose of Processing and Legal Basis

As part of its cooperation with business partners, WECUBEX processes personal data of contact persons at customers, prospective customers, sales partners, suppliers and partners (each a “Business Partner”):

• Contact information, such as first and last names, business address, business telephone number, business mobile telephone number, business fax number and business email address,
• Payment data, such as information required to process payments or prevent fraud, including credit card information and card verification numbers,
• Other information whose processing is required as part of a project or the handling of a contractual relationship with WECUBEX, or which is voluntarily provided by Business Partners, e.g. as part of orders placed, enquiries or project details,
• Personal data collected from publicly available sources, information databases or credit reference agencies, and
• Where legally required as part of compliance screenings: date of birth, identity documents and identity document numbers, information on relevant court proceedings and other legal disputes in which Business Partners are involved.

WECUBEX processes personal data for the following purposes: communication with Business Partners regarding products, services and projects, e.g. to process enquiries from Business Partners or provide technical information about products,

• Planning, conducting and managing the (contractual) business relationship between WECUBEX and the Business Partner, e.g. to process orders for products and services, collect payments, for accounting and invoicing purposes, and to carry out deliveries, maintenance work or repairs,
• Conducting customer surveys, marketing campaigns, market analyses, prize draws, competitions or similar activities and events,
• Maintaining and protecting the security of our products and services as well as our websites, preventing and detecting security risks, fraudulent activities or other criminal or intentionally harmful acts,
• Complying with (i) legal requirements (e.g. statutory retention obligations under tax and commercial law), (ii) existing obligations to carry out compliance screenings (to prevent economic crime or money laundering), and (iii) WECUBEX policies and industry standards, and
• Settling legal disputes, enforcing existing contracts and asserting, exercising and defending legal claims.

The processing of personal data is necessary to achieve the purposes stated above. Unless expressly stated otherwise when the personal data is collected, the legal basis for processing the data is:

IV. TRANSFER AND DISCLOSURE OF PERSONAL DATA

WECUBEX may transfer your personal data to:

• other WECUBEX companies, where this is necessary in connection with the provision and operation of the WECUBEX Online Services or the initiation, conduct or handling of the business relationship,
• IT service providers who process data as part of the services they provide (such as service providers for IT maintenance activities), or
• courts, arbitration tribunals, authorities or legal advisers, where this is necessary to comply with applicable law or to assert, exercise or defend legal claims.

WECUBEX Online Services are hosted by strato.de. Your data may be stored by the respective companies via the data storage, databases and general services of strato and wix.com. They store your data in compliance with the GDPR on secure servers behind a firewall.

V. RETENTION PERIODS

Unless an explicit retention period is specified when the data is collected (e.g. as part of a declaration of consent), your personal data will be deleted if it is no longer required to fulfil the purpose for which it was stored, unless statutory retention obligations (e.g. retention obligations under commercial and tax law) prevent its deletion.

VI. RIGHT TO WITHDRAW CONSENT

If you have given us consent to process your personal data, you have the right to withdraw this consent at any time with effect for the future. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of your consent before the withdrawal.
